MAASTRICHT. A student accommodation building on the Spoorweglaan in Wyck has received a permit for a roof terrace for the second time. The court previously ruled in favour of the complaining neighbour.

After the permit was granted the first time, the neighbour concerned, who lives on the Alexander Battalaan, which runs parallel, took the matter to court. The students didn't just make a lot of noise, they also climbed from the terrace onto the roofs of adjacent buildings. The court ruled that the permit was wrongfully granted, because the city had not taken into consideration that the building concerned was a student house. The judge added that with inhabitants living in digs, chances of a deviant lifestyle is greater than in the case of a house occupied by a family.

The court asked the city to review its decision and, having done so, it decided to issue the permit again. A high railing has been put up to surround the roof terrace, so climbing onto other roofs is no longer possible. In addition, the size of the roof terrace has been reduced: it is now further away from other houses and fewer students fit on the terrace.

The neighbour from the Alexander Battalaan intends to take the matter to court again.
